The Lottery Act, the player and the tax

What the law regulates, and who it is aimed at

The Lottery Act and the Gambling Act regulate whoever offers gambling to Norway. Lotteritilsynet supervises whether operators hold a Norwegian permission, and the law is aimed at the supply side. A person in Norway who deposits money at an online casino without a Norwegian licence therefore commits no offence under those laws. The operator, on the other hand, can breach Norwegian law by directing its offer at the Norwegian market.

The distinction matters, but it grants no freedom. The player's act is lawful in the sense that it is not punishable, while at the same time standing entirely outside a protected consumer relationship. Norwegian complaint schemes apply only to licensed providers, and Lotteritilsynet has no authority to help with a payout or an unreasonable term at an operator without a permission.

The player's position under the Lottery Act

That the law binds the operator means in practice that Norwegian authorities leave individuals alone. There is no legal basis for a fine or imprisonment against a player. The legislator has chosen to regulate the supply side because that is where control is possible.

In return the player is left without the rights that come with a Norwegian licence. No Norwegian supervisory authority can order an offshore operator to pay out a win, and no complaints board will take the case. Tax on winnings from online casinos

The main rule in Norwegian tax law is that winnings from gambling arranged by a licensed Norwegian provider are tax-free. The player is responsible for entering the win on the tax return.
